Public Notice - Environmental Permit

PURPOSE OF NOTICE: To seek public comment on a draft permit from the Department of Environmental Quality that will allow the filling of wetlands and open water in Chesterfield County, Virginia. PUBLIC COMMENT PERIOD: For 30 days, starting from the day after the notice is published in the newspaper. PUBLIC NOTICE DATES: Wednesday, December 31, 2008 to 5:00 p.m. on Friday, January 30, 2009. PERMIT NAME: Virginia Water Protection Permit issued by the Department of Environmental Quality, under the authority of the State Water Control Board. APPLICANT NAME, ADDRESS AND PERMIT NUMBER: TAK TENT L.P., 8899 River Road, Richmond, Virginia 23229. PERMIT NUMBER: 08-1227 PROJECT DESCRIPTION: TAK TENT L.P. has applied for a new permit for the Green at the Village of Midlothian project. The project is located along the north side Woolridge Road, east of Coalfield Road, and south of Midlothian Turnpike (U.S. Route 60) in Chesterfield County. The applicant is requesting a Virginia Water Protection Individual Permit to authorize the filling of wetlands and open water in order to construct an office park with associated recreational facilities. The proposed project will result in the permanent impact to no more than 0.026 acre of forested wetlands and to no more than 0.062 acre of open water associated with unnamed tributaries to Falling Creek in Chesterfield County, Virginia. Impacts are as described in the Joint Permit Application submitted by EnviroUtilities dated June 27, 2008 and supplemental information received on November 3, 2008. Permanent impacts to forested and emergent wetlands will be compensated at a compensation to impact ratio of 2:1 through the purchase of 0.052 acre of wetland mitigation credits from the Chickahominy Environmental Bank located in Charles City County, Virginia. The mitigation bank is located in same HUC and within the same watershed as the project site therefore meeting the requirements of §62.1-44.15:23. A. of the Code of Virginia and 9 VAC 25-210-116. This project is not expected to cause significant impairment to fish and/or wildlife resources, as such, and in accordance with 9 VAC 25-210-80 B.5.(d) compensatory mitigation for open water impacts will not be required at this time. DEQ's preliminary decision is to approve the permit. HOW TO COMMENT AND/OR REQUEST A PUBLIC HEARING: DEQ accepts comments and requests for public hearing by e-mail, fax or postal mail. All comments and requests must be in writing and be received by DEQ during the comment period. Submittals must include the names, mailing addresses and telephone numbers of the commenter/ requester and of all persons represented by the commenter/requester. A request for public hearing must also include: 1) The reason why a public hearing is requested. 2) A brief, informal statement regarding the nature and extent of the interest of the requester or of those represented by the requester, including how and to what extent such interest would be directly and adversely affected by the permit. 3) Specific references, where possible, to terms and conditions of the permit with suggested revisions. DEQ may hold a public hearing, including another comment period, if public response is significant and there are substantial, disputed issues relevant to the permit. Take notice that the Board of Supervisors of Chesterfield County, Virginia, at an adjourned meeting on Wednesday, January 14, 2009 at 6:30 p.m. in the County Public Meeting Room at the Chesterfield Administration Building, Route 10 and Lori Road, Chesterfield, Virginia, will hold a public hearing where persons may appear and present their views concerning:

An Ordinance to amend the Code of the County of Chesterfield, 1997, as amended, by amending and re-enacting Section 19-25 of the zoning ordinance relating to planning fees. The legal authority for enactment of these fees, levies, increases and/or reductions includes the County Charter and Va. Code § 15.2-2286(A)(6). Except as described below, no other new, increased or reduced fees are proposed with this amendment.

In addition to any other fees required by the County under other ordinances, the amendment would change application fees for certain conditional use applications. Fees for conditional uses currently fall into two categories: (1) family day care homes and (2) "all other" conditional uses. The fees for "all other" conditional use applications are currently $5,300 plus $90 per acre for residential uses and $4,100 plus $80 per acre for office, commercial and industrial uses. The proposed amendment would change this fee for two new categories of conditional use applications: (1) "conditional use for any use incidental to a principal dwelling unit except family day care homes" for which the fee would be reduced to $1,000 per application for all uses and (2) "conditional use for recreational facilities and grounds primarily serving the surrounding residential community" for which the fee would be changed to $2,200 plus $95 per acre for residential uses and would not be applicable to office, commercial and industrial uses.

After a public hearing, the Board of Supervisors may approve changes to the amendment. The proposed ordinance amendment and information concerning the documentation for the proposed fee, levy, increase and/or reduction are available for examination by the public in the County Administrator's Office and the Clerk to the Board's Office (Room 504) at the Lane B. Ramsey Administration Building, 9901 Lori Road, Chesterfield Virginia and at the Chesterfield County Planning Department, at the Chesterfield County Community Development Building, 9800 Government Center Parkway, Chesterfield, Virginia. The hearing is held at a public facility designed to be accessible to persons with disabilities. An Ord to amend Code of the County of Chesterfield 1997 as amended by amending Sec 17-73 of Subdivision Ord rel to acceptance of subdivision streets into State system of maintenance surety requirements & exceptions thereto. Current Ord requires streets be accepted into State system not more than 2 years after date of plat recordation within any subdivision. Proposed amdt would allow County to grant an administrative exception to requirement.
